1. Acceptance of Terms
By accessing or using Nebulas.ai, you agree to be bound by these Terms of Service. If you are using the platform on behalf of an organization, you represent that you have authority to bind that organization.
2. Eligibility
You must be at least 16 years old, or the age of digital consent in your jurisdiction, to use Nebulas.ai. By using the platform, you represent that you meet this requirement and, if you connect a third-party account such as TikTok or Facebook, that you also meet that platform's own eligibility requirements.
3. Service Description
Nebulas.ai provides an agentic AI platform including knowledge base management, AI agent deployment, structured data tables, and workflow orchestration tools.
4. Third-Party Platform Integrations
Nebulas.ai offers API access that lets you retrieve performance analytics — such as post identifiers, view counts, and like counts — from third-party platforms including TikTok and Facebook, for accounts you or your organization authorize us to access. We also provide content-generation tools; publishing generated content to Facebook or other social media is a user-initiated action that happens only when you choose to publish and only after you have reviewed and approved the content — Nebulas does not generate content specifically for, or publish automatically to, any platform. Nebulas is designed for organizational use, and you represent and warrant that you are authorized by your organization to connect any TikTok or Facebook account you connect, whether it is your own or belongs to your company, and that doing so complies with your organization's own policies; we have no way to verify this beyond confirming that you hold valid credentials for that account. You manage the permissions granted to us through each connected platform's own account settings, and you are solely responsible for reviewing and approving any content before it is published, and for that content once it is published under your organization's name. These integrations are provided for your convenience and are not endorsed by, certified by, or affiliated with TikTok Inc., ByteDance Ltd., Meta Platforms, Inc., or any other third-party platform. Access to a connected platform remains subject to that platform's own terms of service and policies, including its own authorization and revocation controls, and we are not responsible for the availability, accuracy, or content of third-party platforms.
5. Acceptable Use
You agree not to use Nebulas.ai to: (a) scrape, harvest, or collect data from a connected platform beyond what you are authorized to access; (b) violate the terms of service, community guidelines, or developer policies of any connected third-party platform; (c) upload, process, or generate unlawful, infringing, or harmful content, including AI-generated images that infringe third-party intellectual property rights or that depict real individuals without appropriate rights or consent; or (d) reverse-engineer, disrupt, or gain unauthorized access to the platform. We may suspend or terminate access for violations of this section.
6. User Responsibilities
You are responsible for maintaining the security of your account credentials, ensuring uploaded content does not violate applicable laws, and using AI agents in compliance with relevant regulations. Where you connect a third-party account such as TikTok or Facebook, you are responsible for the data you choose to retrieve and retain in your knowledge base, including ensuring your use of it complies with applicable law and the connected platform's own terms; retention and deletion of that data follow your own account and workspace settings once it has been imported. You are also responsible for configuring the access permissions on any data you import, including TikTok- or Facebook-derived data, so that it is visible only to members of your organization you have authorized to access it. You are responsible for reviewing and approving any AI-generated content before it is published to a connected platform such as Facebook, for that published content complying with applicable law, your organization's policies, and the connected platform's own terms, and for managing the permissions you grant to Nebulas through each connected platform's own account settings. You are responsible for the data you submit to AI agents or otherwise expose to the underlying AI/LLM providers Nebulas uses to process your requests, and for ensuring you are authorized to have that data processed in this way.
7. Data Ownership
You retain full ownership of all content you upload to Nebulas. We do not use your data to train AI models. Your data is processed solely to provide the services you request.
8. Copyright & Intellectual Property Complaints
If you believe that content hosted on Nebulas — including AI-generated images or other AI-generated output — infringes your copyright or other intellectual property rights, send a notice to contact@nebulas.ai including: (a) identification of the work you claim is infringed; (b) identification of the material you claim is infringing and where it can be found on the platform; (c) your contact information; (d) a statement that you have a good-faith belief the use is not authorized by the rights holder, its agent, or the law; and (e) a statement that the information in your notice is accurate and that you are the rights holder or authorized to act on their behalf. We will review valid notices and may remove or disable access to the reported content and, where appropriate, suspend or terminate the accounts of repeat infringers.
9. Service Level Agreement
Enterprise customers receive a 99.9% uptime SLA. For details on our SLA terms, including credits and exclusions, contact our sales team.
10. Limitation of Liability
Nebulas.ai is provided "as is". We are not liable for any indirect, incidental, or consequential damages arising from your use of the platform. Our total liability is limited to the fees you paid in the preceding 12 months.
11. Termination
We may suspend or terminate your account and access to the platform, including any connected third-party accounts, at any time for violation of these Terms or if required by a connected platform's policies (for example, if TikTok or Facebook revokes API access). Upon termination, your right to use the platform ceases immediately, and data associated with disconnected third-party accounts is deleted in line with our Privacy Policy.
12. Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms with a revised "Last updated" date, and we will communicate material changes by email or in-app notice. Continued use of the platform after changes take effect constitutes acceptance of the revised Terms.
13. Governing Law & Dispute Resolution
These Terms are governed by the laws of France, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the platform is subject to the exclusive jurisdiction of the courts of Paris, France, unless mandatory consumer-protection law in your country of residence provides otherwise.
